The Messy Desk Podcast website is owned and operated by Meghan Monaghan and Theresa Cifali (referred to as “us,” “we” or “our”). Both of us have our own separate businesses. This website is meant to serve as a repository for our weekly podcast episodes and any collaborative projects, services, or products we offer. Our website address is: https://messydeskpodcast.com. What Personal Data We Collect and How We Use It

We collect the following types of information:

Information You Provide To Us or Give Us Permission to Access and Use on Your Behalf

When using this site or purchasing products or services from us, we may ask you for Personal Data. We receive and store this personal information that you knowingly provide to us.

We collect Personal Data that may include – but is not limited to – your:

  • first and last name,

We may also provide this aggregate information to our partners; our partners may use such information to understand how often and in what ways people use our website. Aggregated data is not personal information.

When you visit our site, we may automatically record information (“log data”), including information that your browser sends whenever you visit our site. This log data may include the web address you came from or are going to, your device model, operating system, browser type, unique device identifier, IP address, mobile network carrier, and time zone or location.

We might also use a pixel tag which is a small graphic file that allows us and third parties to monitor the use of the site and provide us with information based on your interaction with the site. These tags may collect the IP address from the device which you loaded the page, the browser type. Pixel tags are also used by our third parties to collect information when you visit our site, the links and other actions you take on our site, and we may use this information in combination with cookies to display targeted advertisements.

How We Use Your Information

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection. Comments may be checked through an automated spam detection service.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Consent

When you provide us with personal information to complete a transaction or deliver a service, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent or provide you with an opportunity to say no.

In the case of email, we require a double opt-in if you want to download any free materials and be added to our list. By submitting your personal data to us so that we may contact you via email for promotional offers and to communicate with you about previous purchases, you consent to us contacting you and you consent to this policy. If you do not want to receive email from us or give us consent to send you email, please do not confirm your subscription during the opt-in process. Also, we may receive a confirmation when you open an email from us. This confirmation helps us analyze and improve our emails. If at any time you do not want to receive email or other mail from us, please indicate your preference by selecting the opt-out option (“Unsubscribe”) at the bottom of our emails or by emailing us at messydeskpodcast (at) gmail.com.

Please note that if you do not want to receive legal notices from us, those legal notices will still govern your use of the site, and you are responsible for reviewing such legal notices for changes. Also, if you choose to withdraw your consent from emails related to products or services that you have previously purchased, you do so at your own risk since we can no longer contact you and therefore cannot be responsible for alerting you about any changes to those products or services, including cancellations, new login procedures, or discontinued offers.

By using this site, you represent that you are at least the age of majority in your state or province of residence or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

Disclosure

We do not sell, rent, or distribute your Personal Data. If we are required by law to do so or if you violate our Terms of Service, we may disclose your personal information.  We do share your Personal Data with third parties as follows under these circumstances:

We employ other companies, agents or contractors (“Service Providers”) to perform tasks on our behalf to help us provide services to you. We may need to share your information with them to provide products or services to you and to provide other services such as marketing, advertising, communications, infrastructure and IT services, customer service, debt collection, and data analysis. Unless we tell you differently, our Service Providers do not have any right to use the Personal Data we share with them beyond what is necessary to assist us. We do not authorize them to use or disclose your personal information except in connection with providing their services.

B. For business transfers. We may choose to buy or sell assets. In these types of transactions, customer information is typically one of the business assets that would be transferred. Also, if we (or all of our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Data would be one of the assets transferred to or acquired by a third party.

C. For the protection of our company and others. We reserve the right to access, read, preserve, and disclose any information that we reasonably believe is necessary to comply with law or court order; enforce or apply our conditions of use and other agreements; or protect the rights, property, or safety of Company, our employees, our users, our customers, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

D. With your consent. Except as set forth above, you will be notified when your Personal Data may be shared with third parties in personally identifiable form, and you will be able to prevent the sharing of this information.

Third-Party Payment Processing

Our podcast is free.  However, for any paid product, service or subscription we offer, please note that we do not collect or store your credit card details. Various payment processing providers provide us with the online e-commerce platform that allows us to sell our products and services to you via payment processing. Please read their Terms of Service and Privacy Statement as applicable for up to date information about their practices and policies.

Once you leave our website or are redirected to another party for payment processing, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

Third-Party Services

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways, other payment transaction processors, Google Analytics, or Facebook, have their own privacy policies with respect to the information they collect. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your Personal Data will be handled by them.

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act. Once you leave our website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

Security

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. We use reasonable administrative, logical, physical and managerial measures to safeguard your personal information against loss, theft and unauthorized access, use and modification. Unfortunately, no measures can be guaranteed to provide 100% security. Accordingly, we cannot guarantee the security of your information.

When you click on links on our site, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements. We assume no responsibility for the content, policies or practices of other sites.

Retention of Data and Your Rights

We retain your Personal Data only for as long as is necessary for the purposes set out in this policy, including but not limited to service and product delivery as well as for communication purposes. We will retain and use your Personal Data to the extent necessary to comply with our business obligations to you as a client or customer and to comply with legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

We retain aggregated data for internal analysis purposes as needed, but this is not personally identifiable information. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

Your Personal Data Rights and Access

We aim to take reasonable steps so you can correct, amend, limit or, if absolutely necessary, delete your Personal Data.

Email Preferences

As described above, if you do not wish to receive promotional and communicative e-mails from us, you may opt-out by clicking the “Unsubscribe” option at any time in one of the emails we have sent to you. Although you may opt-out from promotional e-mail, we may still send you transactional and administrative emails about this privacy notice or about the products or services you have purchased.

If you unsubscribe from our email list, the Personal Data that you provided (generally a name and email address) will still be in a record of you but your “unsubscribed” status will be retained so that we do not contact you in the future per your request.

Check your browser’s help function on how to set your computer to accept all cookies, to notify you when a cookie is issued, or to not receive cookies at any time. This is a setting you control and it is out of our control.

Advertising

To opt out of advertising on other platforms, please check with those platforms as to their policies and processes.

Upon your request, we will provide you a copy of the Personal Data we hold about you. We require identity verification before we can respond and comply with such requests. We reserve the right to decline to requests that are frivolous, vexatious, impractical, jeopardize the privacy of others or for which access is not otherwise required by local law. In some cases, we may not be able to remove your personal information due to administrative, legal, or security purposes, in which case we will let you know why.
